HAULER AGREEMENT.
This is the agreement between JunkZipp and your hauling company. You accept it when you submit your application, and it applies to every job you take through the platform. Read it with the customer Terms, which set out what we have promised the customer on your behalf.
01 · What this is
JunkZipp finds customers, prices their jobs from photos, and offers those jobs to approved haulers through the app. You choose which offers to accept. When you accept one, you agree to do that job for the customer at the price JunkZipp has already agreed with them, and JunkZipp agrees to pay you your share as set out below.
There is no membership, no lead fee and no charge for turning a job down. JunkZipp earns only the difference between what the customer pays and what you are paid.
02 · You are an independent contractor
Your company is an independent business. Nothing in this agreement makes you or your crew an employee, agent, partner or joint venturer of JunkZipp. You decide whether to accept any offer, you supply your own truck, crew, tools and insurance, you set your own hours, and you are responsible for your own taxes, licenses, permits, wages and workers’ compensation.
You may not hold yourself out as JunkZipp, sign anything on JunkZipp’s behalf, or make promises to a customer beyond the job you were sent to do. JunkZipp will issue you a Form 1099 where the law requires it.
03 · The money
Your share. For every job you complete, you are paid 75% of the price the customer approved, including any extras and any change to the price the customer approves on the day. JunkZipp keeps the rest. If a job goes unclaimed and we raise the offer, the extra $20 is added to your share.
You never take money from the customer. The customer pays JunkZipp; JunkZipp pays you. You do not accept cash, card, Zelle, check or anything else from a customer, you do not give them a price of your own, and you do not tell them what to pay. If a customer tries to hand you money, decline it and point them to the payment email JunkZipp sends when you close the job. Taking payment from a customer is a breach of this agreement and ends it.
Settlement.The moment you close a job in the app with the after photo, your share for that job is owed to you and goes on your owed list. JunkZipp pays what it owes you weekly. The app shows what is owed and what has been paid at all times, and you get a message when a job is added and when it is paid. Collecting from the customer is JunkZipp’s job, not yours, and your share does not wait on it.
Trip fee.A customer can cancel for free until you tap “on the way”. If a job is cancelled after that, or the customer is not there when you arrive, JunkZipp bills the customer a $45 trip fee and $35 of it is owed to you straight away, paid with the rest of what JunkZipp owes you.
04 · Taking a job
Offers show the photos, the neighbourhood, the extras and your share. The first hauler to accept gets the job and receives the customer’s address, phone number and access notes. Once you accept:
- the job is yours to do at the agreed price and in the agreed window; you may not pass it to another company;
- you mark yourself on the way, arrived, loading and done in the app as it happens, because the customer is watching those steps;
- if the load is bigger or different from the photos, you do not price it for the customer yourself; you send a photo and the pay you need through the app, and wait for the customer to approve the new price;
- you take an after photo when the load is out and close the job in the app; JunkZipp then bills the customer.
Backing out of a job you accepted, or not showing up, leaves the customer stranded. Each one is recorded as a strike. Three strikes and we stop sending you offers.
05 · Documents and standards
To take jobs you must keep on file with us a current business license, a certificate of general liability insurance, and your Miami-Dade hauling decal number, and tell us before any of them expires. Dispatch stops automatically on the expiry date we have recorded, and it stops immediately if you tell us or we learn that coverage has lapsed.
You also agree that on every JunkZipp job you will:
- dispose of everything legally at a licensed facility, and handle refrigerants, tires, mattresses, electronics, paint and chemicals as the law requires;
- treat the customer, their property and their neighbours with respect, and leave the site clean;
- never take money from the customer or ask them for any, tips excepted if they offer;
- carry your own insurance for damage to the customer’s property and for injury to your crew, and handle any such claim promptly with your insurer;
- use the customer’s address, phone number and photos only to do the job, and delete them when it is done.
06 · JunkZipp customers stay JunkZipp customers
The leads are free because the customer relationship is ours. You agree not to take a JunkZipp customer’s job, or any later job for that customer or at that address, directly off the platform for twelve months after you were sent there, and not to hand them your own card, price jobs for them yourself, or steer them to book with you directly. A customer who asks for you by name is welcome; they book through JunkZipp and we send you. Breaking this ends the agreement and forfeits any unpaid share.
07 · Location, notifications and the app
While you are marked on the way to a job, the app sends your truck’s position so the customer can see you coming and we can give them an arrival time. It stops when you arrive, it is never taken when you have no active job, and we delete it when the job ends. JunkZipp staff can see your live position during an active job. Offers arrive by push notification and email, and an offer expires if nobody accepts it in time, so keep notifications on while you are marked available. Our Privacy Policy explains what we keep.
08 · Liability and indemnity
You are responsible for the work, the truck, the crew and the disposal. You will defend and indemnify JunkZipp against claims by customers or third parties arising out of a job you performed, your crew’s conduct, your vehicles, your disposal practices, or your breach of this agreement.
JUNKZIPP PROVIDES THE PLATFORM “AS IS.” JUNKZIPP DOES NOT GUARANTEE ANY VOLUME OF OFFERS OR JOBS. TO THE FULLEST EXTENT PERMITTED BY LAW, JUNKZIPP’S TOTAL LIABILITY TO YOU IS LIMITED TO THE AMOUNTS OWED TO YOU FOR COMPLETED JOBS, AND JUNKZIPP IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES.
09 · Ending the agreement
Either of us can end this agreement at any time by email. Jobs you have already accepted must still be completed, and JunkZipp will still settle your share for every job you completed. We may suspend or remove you immediately for lapsed documents, customer complaints we find credible, a safety issue, taking customers off the platform, or any breach of this agreement, and we will tell you why.
On ending, any share JunkZipp owes you for completed jobs is paid on the next settlement.
10 · Governing law, changes and contact
This agreement is governed by the laws of the State of Florida. Disputes go first to a thirty-day good-faith discussion by email, then to the state or federal courts seated in Miami-Dade County, Florida.
We may update this agreement. We will email you about material changes, and continuing to accept offers after the effective date is acceptance. The share, trip fee and bonus figures above are the ones in force on the effective date and are shown in the app on every offer.
